If you play Artifact, youindicate your acceptance of the terms of this Agreement and you subscribe to, orbecome a "Player" (defined below) of the Artifact service (the "Service") andmay use the Artifact client software (the "Software") under these terms.1. Membership. By accepting the terms of this Agreement, you have become aPlayer of the Service with the privilege to use the Service and the obligationsset forth in these terms.2. License. As a Player, you may use the Software solely for purposes ofaccessing and using the Service. You may copy the Software in order to use theSoftware on more than one computer, to provide copies to another person (subjectto acceptance of these terms by the other person) or to make backup copies,provided that you reproduce the copyright notice on any copy of the Software.You may not use, copy, modify or distribute the Software other than as set forthin this paragraph 2. You may not decompile, reverse engineer or disassemble theSoftware.3. Ownership. Samu Games is the owner of the Service and the Software andthe copyrights, trade secrets, patents and other intellectual property rights inthe Software.4. Membership Requirements. Your membership in the Service and use of theSoftware are subject to following membership requirements, and your membershipand license are subject to termination by Samu Games in its discretion (at anytime and without notice) for violation of these terms:(a) You must provide Samu Games with your full real name along with your currentvalid address, email address and telephone number during the registrationprocess.(b) The Service is intended to be an enjoyable place for as many members aspossible. To achieve this goal, Samu Games has developed a set of CommunityGuidelines (defined below). You agree to cooperate with Samu Games in itsefforts to create generally accepted standards for the Service and to complywith the Community Guidelines. Samu Games reserves the right to determine, inits sole discretion, the generally accepted standards for the Service and theCommunity Guidelines.(c) If you contribute any material (including map designs), you represent thatall material you contribute to the Service does not violate anyone else's rights(including copyright, trademark, privacy and publicity rights). Furthermore, yougrant to Samu Games the nonexclusive right to use, copy, modify, distribute andotherwise make available the material in connection with the Service.(d) You will not disseminate material or engage in behavior on the Service thatis obscene, sexually explicit, abusive, deceptive, defamatory, hateful orotherwise inappropriate (as determined by Samu Games).(e) You will not engage in behavior that disrupts the performance of the Serviceor the experience of its members, including, but not limited to, behavior suchas hacking, cheating, impersonation, harassing, spamming, or spreading ofcomputer viruses.(f) You will not allow other players, whether clan members, allies in aparticular game or personal acquaintances, for free or for charge, to use youraccount. Your account password is not to be given out.(g) You acknowledge that the Service is intended for an audience of 18 years ofage or older. Certain games, editorial material provided by Samu Games, andmaterials created by Samu Games members (e.g., chat) may not be suitable forminors. If you permit minors to use your account, you will be responsible forthe minor's behavior on the Service and for any charges incurred by such minors.Furthermore, you acknowledge that Samu Games is not responsible for, and has noliability arising out of or related to, such minors' exposure to any materialmade available on the Service. As in most things, parental guidance andresponsibility is suggested and encouraged.5. Community Guidelines. Since people of diverse ages, backgrounds,religions, and nationalities play the Service, it is expected that the playerswill refrain from speech that is deliberately inflammatory, excessively vulgar,and/or personally derogatory. In other words: No flaming and keep the "trashtalk" to a minimum. This applies to the general chat (public and private) aswell as the notes (public and private). Pushing excessive quantities of chat(public or private) into the game, whether directed at the entire game or at aparticular player is considered spamming. This will not be tolerated and willresult in the temporary suspension of all communication options on the Service.As the Service is utilized by players from many different countries fromaround the world, it is imperative that players allow each other tospeak in their native languages. The public chat and note forums are notthe exclusive domain of any one language. In addition, using the Serviceto promote the distribution of or access to warez, MP3s, or otherillegal software or products is strictly forbidden and will not betolerated. Using the Service to distribute pornography or access topornography of any kind is strictly forbidden and will not be tolerated.The various Administrators are expected to enforce the Community Guidelines ofthe Service. When they think that a player or players have violated theCommunity Guidelines, they will suspend the communication options for theplayer(s) and possibly boot the player from the Service. Repeated violationswill result in the termination of the player(s) account(s).6. Modification of this Agreement. You understand and agree that Samu Gamesmay modify this Agreement at any time and in any manner. Any modification iseffective immediately upon posting on the Service. By continuing to use of theService following modification to this Agreement, you accept the modification.If any modification to this Agreement is not acceptable to you, you mayimmediately terminate your Membership as explained below.7. Termination. You may terminate your membership at any time by email orpostal US; your termination will be effective once Samu Games has actuallyreceived the notice. Samu Games may terminate or suspend your membership at itsdiscretion (at any time and without notice) if you breach any of the terms ofthis Agreement (including, but not limited to, failure to act in accordance withthe generally accepted Community Guidelines established by Samu Games) or if anyof the representations you make in this Agreement turn out to be false.In addition, the Service will periodically remove inactive free accounts. If afree player account is unused for 90 days or more, the Service will delete thataccount.8. Limited Warranty; Limitation of Remedies. THE SOFTWARE AND THE SERVICEARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED,INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY ANDFITNESS FOR A PARTICULAR PURPOSE. SAMU GAMES DOES NOT WARRANT THAT THE FUNCTIONSCONTAINED IN THE PROGRAM WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OFTHE PROGRAM OR OF THE SERVICE WILL BE UNINTERRUPTED OR ERRORFREE. IN NO EVENTWILL SAMU GAMES BE LIABLE TO YOU FOR ANY DAMAGES, INCLUDING BUT NOT LIMITED TOANY LOST PROFITS, LOST SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGESARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR THE SERVICE, EVEN IFSAMU GAMES HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIMBY ANY OTHER PARTY. IN NO EVENT WILL SAMU GAMES BE LIABLE FOR ANY DAMAGES INEXCESS OF THE STANDARD MEMBERSHIP FEE(S) FOR THE SERVICE. Some states do notallow the exclusion of implied warranties or the limitation or exclusion ofliability for incidental or consequential damages, so the above exclusions maynot apply to you.9. General. This agreement is the complete and exclusive agreement betweenyou and Samu Games and supersedes any proposal or prior agreement, oral orwritten, and any other communications between you an Samu Games relating to thesubject matter hereof. The laws of the State of Oklahoma will govern thisAgreement. BY USING THE SERVICE OR THE SOFTWARE, YOU ACKNOWLEDGE THAT YOU HAVEREAD AND UNDERSTAND THIS AGREEMENT AND AGREE TO BE BOUND BY ITS TERMS. |
